Information on Data Portability and Provider Switching

This page contains the pre-contractual information pursuant to clause 3.1 and the online register pursuant to clause 3.2 of the Annex “Provisions on Provider Switching” to our General Terms and Conditions. It is addressed to entrepreneurs within the meaning of clause 1.2 of the Terms.

A. Pre-contractual Information (clause 3.1)

1) Standard remuneration and penalties for early termination

The standard remuneration is EUR 365.00 per year. No VAT is charged, as the Provider is exempt from VAT as a small business.

The remuneration is invoiced in advance for the agreed service period and paid by bank transfer (clause 9.3 of the Terms). The contract is concluded for a fixed term and ends automatically upon expiry of that term (clause 10.1 of the Terms); it does not renew automatically.

No penalties for early termination are provided for.

2) Switching fees

No switching fees are charged. The Provider does not charge any additional remuneration for the switching process (clause 10 of the Annex).

3) Services requiring a highly complex or costly switch

None. All Customer data is held in tabular form and as image files and is provided in open, widely used formats. No proprietary formats or proprietary data structures are used.

4) Services to which the switching and termination obligations do not apply

None. The provisions of the Annex apply to the entire scope of services.

5) Categories of data and digital assets that can be transferred

The full list appears in Part B of this page. It includes at least all exportable data within the meaning of clause 2.5 of the Annex.

6) Categories of data exempted from export due to trade secrets

None. The Provider does not exempt any category of Customer data from export on the grounds of trade secrets.

Clarification: the Provider's internal operating records — in particular the internal change and security log, internal handling notes and subscription administration — are not Customer data. They therefore do not constitute an exempted category; they fall outside the exportable data in the first place.

7) Known risks to the continuity of provision

The service is operated by a sole proprietorship. Data is hosted on the infrastructure of a third-party provider within the European Union; no storage outside the EU takes place.

The Customer may at any time request a full copy of their data in the formats listed in Part B.

  • Dates and times: ISO 8601, Coordinated Universal Time (UTC)

  • Image files: WebP
  • Delivery: one ZIP file per Customer, one file per category

All formats listed are openly documented and readable without special software.

B.3 Notes on individual categories

Image files: uploaded photographs are converted to WebP format during upload and limited in their dimensions. The file originally uploaded by the Customer is not stored and can therefore not be provided.

Multilingual content: the Customer enters their content in one language; the versions in the other two languages are machine-generated. Both are exported in the same way.

Access credentials: passwords are stored exclusively in non-reversible form. They cannot be recovered, cannot be transferred and are therefore not subject to export.

C. Switching and Exit Plan (clause 4.1 of the Annex)

This Plan is deemed agreed between the parties as soon as the Customer confirms it in text form when setting up access. It is confirmed or updated again when a switch is initiated.

C.1 Contact persons

The Provider's contact person is Michail Frantzeskakis, info@paragogoi.com. The Customer's contact details are those held in the Customer's account. Changes are notified to the other party in text form without undue delay.

C.2 Switching and exit assistance: methods and formats

The Provider makes all of the Customer's exportable data available as one ZIP file, with one file per data category. The categories and formats follow from Part B of this page in the version in force when this Plan is confirmed.

Handover takes place via a time-limited, personalised download link. Unencrypted data is not sent by email.

C.3 Required steps

  1. The Customer sends the switching notification per clause 5.1 of the Annex.
  2. The Provider confirms receipt within 3 working days by the same means of communication (clause 5.3).
  3. The parties confirm or update this Plan, in particular the contact persons and any target provider.
  4. The Provider creates the data package.
  5. The Provider supplies the download link; the Customer confirms receipt in text form.
  6. At the Customer's request, a test is carried out per C.7.
  7. After the transitional period ends, the 30-calendar-day data retrieval period begins (clause 9.1).
  8. After it ends, the Provider deletes the data and confirms the deletion in text form (clause 9.2).

C.4 Time estimate for export and transfer

The complete data package is created and made available within five working days of confirmation of this Plan in a switching case. That is well within the 30-calendar-day transitional period under clause 6.1. The transfer itself takes less than an hour for a normal volume of data.

C.5 Limitations and technical restrictions

  • No storage of exportable data outside the EU. All of the Customer's exportable data is stored exclusively on infrastructure within the European Union. For that reason there are no restrictions within the meaning of the fourth indent of clause 4.1.
  • Image files exist only in WebP format; the file originally uploaded by the Customer is technically not stored.
  • Access credentials are stored exclusively in non-reversible form and are not transferable.
  • Foreign-language content in English and German is machine-generated from the source language unless the Customer entered it himself; it is delivered as is.
  • Importing the data into the Customer's systems or those of the target provider is the Customer's responsibility (clause 8.1). The Provider does not owe adaptation of the data to any particular target system.

C.6 Sequence of operations proposed by the Provider

Switching notification → confirmation of receipt → confirmation of this Plan → creation of the data package → delivery and confirmation of receipt → optional test → data retrieval period → deletion and deletion confirmation.

C.7 Testing method proposed by the Provider

At the Customer's request, the Provider supplies a data package with the Customer's actual data in advance. The Customer or the target provider performs a trial import and reports the result in text form. If problems arise, the parties analyse the causes in good faith and work towards solutions (clause 4.3).

C.8 Updating

The parties update this Plan as necessary and at least at the Customer's request (clause 4.4).
